Standard Terms and Conditions: QUIMERA GALLERY

1. Scope of Representation
- We do not represent artists exclusively unless there is a contractual agreement to do so. We merely are showcasing your art at our venue.​
2. Commission and Payment

Split: The industry standard is often a 50/50 split, but we are currently a 65/35 split where the artist gets 65%

Payment Timeline: Artists will get paid as soon as the return window is closed. which is 7 days from purchase or delivery.

Discounts: Discounts on art work are always cleared with the artist. The artist has final say in change of price or discount unless artist sets terms.
3. Pricing and Title

Retail Price: This is set by gallery and artist

Ownership: The title of the artwork remains with the artist until the piece is paid for in full by a buyer.
4. Shipping and Insurance

Inbound/Outbound: Artists are responsible for dropping off and picking up their art work from the gallery unless another arrangement is agreed to.

Insurance: We are a fully insured gallery, so your work will be protected while in our possession.
5. Copyright and Promotion

Usage Rights: The artist retains the copyright however the gallery will ask artist about advertising, using those images for promotion or social media.

Photography: Photography will be used for social media purposes and if photographers use the gallery for photoshoots. If you choose not to have your art work in photoshoots, that can be arranged.
6. Sales and Returns

All Art is final sale, no returns. Exceptions are if the artist allows it or allows an exchange.

Having said that, Terms and Conditions (“T&C”) are a set of legally binding terms defined by you, as the owner of this website. The T&C set forth the legal boundaries governing the activities of the website visitors, or your customers, while they visit or engage with this website. The T&C are meant to establish the legal relationship between the site visitors and you as the website owner.
T&C should be defined according to the specific needs and nature of each website. For example, a website offering products to customers in e-commerce transactions requires T&C that are different from the T&C of a website only providing information (like a blog, a landing page, and so on).
T&C provide you as the website owner the ability to protect yourself from potential legal exposure, but this may differ from jurisdiction to jurisdiction, so make sure to receive local legal advice if you are trying to protect yourself from legal exposure.
What to include in the T&C document
Generally speaking, T&C often address these types of issues: Who is allowed to use the website; the possible payment methods; a declaration that the website owner may change his or her offering in the future; the types of warranties the website owner gives his or her customers; a reference to issues of intellectual property or copyrights, where relevant; the website owner’s right to suspend or cancel a member’s account; and much, much more.
